In fact, I would say that the more ideologically entrenched versions of the Tory Party and Labour is another point for the LDs. Politically, this has been manna from heaven as the LDs can now identify seats that they can fight for, where previously they had no chance, and I think they may well win them. Ironically, during the Blair era when the LDs should have been a total irrelevance, they continued to pick up seats.

Scottish courts rule prorogation unlawful @lewis_goodall Let’s make no bones about this, these are some of the highest and most distinguished judges in Britain essentially calling the PM, his team and cabinet ministers liars- and saying they lied to the Queen. @lewis_goodall This is bad for the Palace. The Queen relies on the sound and honest counsel from her prime minister not to put her in a position where she is acting a) politically b) controversially c) unlawfully. PM had already failed on A and B. C is a real kicker. Imagine they’re furious. |

Basically he lied to her about the reasons why he needed to porogue parliament. Parliament cannot be porogued without the monarchs consent. The court stated... “Accordingly the court will make an order declaring that the prime minister’s advice to HM the Queen and the prorogation which followed thereon was unlawful and is thus null and of no effect.” It will now go to the Supreme Court to make a final decision on Tuesday.

He told herself that he needed to porogue parliament in order to bring forward a new legislative program. The highest court in Scotland found this to be untrue and that the Queen acted unlawfully based on this untruth. The real reason the court found was to stymy parliamentary scrutiny with regards to brexit. As you can imagine betty will not be best pleased to have been put in this position. If the Supreme Court in London agrees with the court in Scotland then parliament will have to be reopened. If the supreme Court disagrees with the highest court in Scotland then its a gift for Scottish nationalists to bleet on about the supreme court of the UK actually being an English supreme court which trumps Scottish law. All in all a fine mess.

I'm confused Ted. Is there a difference between the legal system in Scotland and England? I thought its was all the same UK legal system? Also why did Rees Mogg have to go to Scotland to visit the Queen? Could he not have met her in Windsor or Buckingham Palace? I thought Boris never met her? Also wasn't it well known he was abandoning parliament so that he could force through his kamikaze plan and waste time for the opposition? Why is this such a surprise to the court? I thought he was entitled to do it simply because he is the PM and can do it for any reason he likes? So much pomp to goings on over there.

Yep. There is a Scottish Legal system and an NI one too. They are intertwined, but there is one.
However, as this is an administrative law matter, I can’t imagine the legal tests to be widely different. As things stand this case has a 1-1 outcome and the SC will break the deadlock. No mandatory order was made here so it is really just a declaration. Depending on the outcome, the SC may go further. there are a number of challenges from England and NI too, so they may all travel together.

Scottish law is very different to English law. It is older than the union itself. Both countries have similar but separate court systems. there's a Supreme Court at the very top which is the highest court in the UK. Decisions by the SC are final unless you take the case to the european court of justice, however I understand this case cannot go to Europe. Rees Mogg went to Scotland to meet the Queen simply because that's where she was at the time. She spends most of the year in balmoral. he would have met her in Windsor or Buckingham palace had she been there.
