So we were sale agreed 3 months ago with a purchaser who dragged their heels and eventually pulled out, costing us 8 weeks of prime viewing time in May/June. We know he has unsuccessfully bid on another house nearby and looked at several others.
He is back in to us with a lower bid than before which we plan to negotiate up but my question is this: As he has messed us around before, can we stipulate that the booking deposit is non refundable if he pulls the sale again? Or can we progress the sale with the understanding that if we get a better offer at any point in the process we can pull out and go elsewhere. Cheers in advance.

Nope, deposit is refundable until contracts are signed.
You can keep marketing the property, but the purchaser would be foolish to agree to that!
