With unfair dismissal aren’t you entitled to your position back as well ??

No entitlement to that. It is an available remedy, but usually tribunals in the UK and definitely in Ireland avoid reinstatement as the fall out is deemed to warrant the ending of the relationship, even in the event of an unfair dismissal.

Very rare. Imagine taking an unfair dismissal case against your employer and being reinstated by order of a state body. Hello darkness my old friend.

It's a pretty good indication of the standard issue moral bankruptcy inherent in a modern football club. The individual who had the least culpability (certainly in a legal sense) for the incident has received a level of punishment which completely dwarfs the six week's wages fine the other two got. Basically he got fired whilst the other two got the equivalent of a slap on the wrist - neither player was even suspended by the club for any material period of time that I'm aware of. And then the club releases a statement which includes the following:
"As we have said from the outset, the club will not tolerate any of its players or staff behaving in a manner which puts themselves, their colleagues, and members of the general public at risk of injury or worse, or which brings the club into disrepute.” So the club will NOT tolerate this behaviour from anyone. Well, anyone who isn't deemed a large enough 'asset' at least. It sets a wonderful example for all those aspiring young kids out there - if you become enough of a big shot you can get away with pretty much anything. But if you're an aging pro who's given seven year's of service you'll be discarded like rubbish. Derby County have handled this whole indecent appallingly. From their initial opening statement in which they were clearly lining Keogh up to be the fall guy through to playing the two F1 drivers the following weekend and finally the latest stunt.

Yes, but for obvious reasons it's rarely something the plaintiff would elect for.

I think though that as a breach of contract claim, he could possibly sue them for the full value of the contract. If there is an exclusion clause that says if you are injured by your own misadventure they don't have to pay you, then he could be in trouble, however. I would guess that a lot of footballers' contracts have clauses like that in them. If Keogh's does, that could be why they were on more solid ground sacking him, or at least ground that means they don't stand to lose too much if he sues them.

This deserved more of a reaction TJ I think most people have no issue with him being sacked. It's the other 2 players getting away with it, aside from being fined 6 weeks wages. Apparently Keogh was offered a reduced contract for the remaining 18 months and turned it down. As was said, it looks like losing in court will be too severe on Derby unfortunately. Ah well, looks like Derby will be this years Ipswich, a lot of Irish fans will be hoping they have a shocking season.

Was chatting with Derby fans in London before their game against Brentford last month and they absolutely loved Keogh. They also said he might not have been completely blameless over the Forest incident as he's very passionate and likes a good row

Apologies for new thread but couldn't find original.
The accident was over 10 months ago now. Anyone know how his recovery is going? Will he ever play again?

Isn’t he out until at least December? I think? Would have to find a new team to take him on then, and who knows how he will physically recover.
